Welcome to Nuiter. By downloading, installing, accessing, or using our mobile application on iOS or Android devices, you expressly agree to be bound by these Terms of Service and End User License Agreement (EULA). If you do not agree to all terms and conditions herein, do not use the application.
1. Minimum Age Requirement (18+)
Nuiter is strictly intended for individuals who are at least 18 (eighteen) years of age. By registering an account or entering your date of birth, you solemnly affirm and warrant that you are 18 years of age or older. Any use by minors is strictly prohibited and will result in the immediate and permanent deletion of the account.
2. Community Guidelines and Zero Tolerance (Apple & Google Policies)
Zero Tolerance for Abusive or Objectionable Content: Nuiter strictly enforces a zero-tolerance policy against harassment, hate speech, bullying, violence, pornography, unlawful discrimination, or abusive conduct of any kind. Accounts violating these standards will be permanently banned immediately without prior warning.
By using Nuiter, you covenant and agree to:
- Use authentic, recent photographs accurately representing yourself (impersonation, celebrity photos, graphic content, or nudity are forbidden).
- Treat all matches and members with dignity, kindness, and mutual respect.
- Never use the chat or matching interface for commercial solicitation, scams, cryptocurrency schemes, financial fraud, or unconsented sexual solicitations.
- Utilize the built-in Block and Report tools available on every profile and conversation to flag suspicious behavior. Reports are reviewed by our moderation trust and safety team within 24 hours.
3. Astro VIP Auto-Renewing Subscriptions (In-App Purchases)
Nuiter offers optional premium subscription tiers marketed as Astro VIP, granting access to premium benefits including seeing who liked you, advanced zodiac filter criteria, unlimited synastry reports, and weekly Super Moons.
Clear Subscription & Auto-Renewal Terms:
- Available Plans: Monthly ($9.99/month), Quarterly ($24.99 every 3 months), or Annual ($59.99/year).
- Billing: Payment will be charged to your Apple ID Account (iOS) or Google Play Account (Android) upon confirmation of purchase.
- Automatic Renewal: Subscriptions automatically renew for the same tier duration and price unless canceled at least 24 hours prior to the conclusion of the current billing cycle.
- How to Cancel or Manage: You can manage and turn off auto-renewal at any time through your device account settings:
• On iOS (iPhone): Open Settings > [Your Name] > Subscriptions > Nuiter.
• On Android: Open Google Play Store > Profile icon > Payments & Subscriptions > Subscriptions > Nuiter.
- Restore Purchases: When transferring to a new device, tap "Restore Purchases" on the Paywall view to restore your active VIP entitlements at no additional charge.
4. Billing, Cancellation, and Refund Policy
All in-app purchases and digital transactions on Nuiter are processed in accordance with platform rules and relevant consumer statutes:
A. Subscriptions (Astro VIP) & Statutory Cancellation Rights:
- United States State-Specific Cancellation Rights: For subscribers residing in certain US jurisdictions (including California, New York, Illinois, Ohio, and Minnesota), you may cancel your initial subscription without penalty or obligation within 3 (three) business days following the date of purchase (prior to midnight of the third business day).
- No Partial Refunds: Except where mandated by local statutory law, subscription payments are non-refundable and there are no refunds or credits for partially used billing periods. Canceling your renewal retains VIP benefits until the conclusion of the active billing cycle.
- Submitting a Refund Request: Purchases made via Apple App Store or Google Play Store are subject to Apple’s and Google’s refund guidelines. You must submit your claim directly through Apple (reportaproblem.apple.com) or Google Play customer support. For Web/Stripe purchases, please contact our support team at support@nuiter.app.
B. Consumable Virtual Items (Super Moons & Credit Packs):
- Immediate Delivery & Forfeiture of Cancellation: Super Moons and standalone credit packages are digital consumables made immediately available upon purchase. By purchasing and utilizing any consumable item, you acknowledge that delivery is instantaneous and you irrevocably waive any statutory right of cancellation or refund once consumed.
C. Anti-Fraud & Negative Balance Policy:
- If a user initiates a chargeback or secures a refund for a VIP tier that came with bonus credits, or for a consumable credit pack that has already been spent, Nuiter's platform will automatically deduct the corresponding credits.
- If the remaining credit balance is insufficient to cover the refunded items, the account will be placed into a Negative Credit Balance (Debt). Nuiter reserves the right to restrict account features, withhold matching abilities, or suspend the profile until outstanding balances are resolved.
5. Nature of Astrological Calculations
Planetary positionings, celestial houses, and astronomical aspects are calculated using scientific ephemeris algorithms based on the Swiss Ephemeris and NASA/JPL planetary data. However, all horoscope readings, synastry compatibility percentages, and astrological interpretations are provided for entertainment, personal insight, and affective inspiration. Nuiter does not warrant or guarantee romance success or relational compatibility.
6. Intellectual Property Rights
All intellectual property rights associated with Nuiter — including visual design, celestial mandalas, branding logos, proprietary compatibility algorithms, software source code, and user interface elements — are the exclusive property of Nuiter Technologies. Any reverse engineering, disassembly, copying, or redistribution without express written permission is strictly prohibited.
7. Account Termination
You may terminate your account at any time within the application settings. Nuiter reserves the full right to suspend or terminate accounts that breach community rules or legal requirements, without entitlement to refund for unused subscription periods.
8. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with applicable governing law. In the event of disputes, the parties submit to competent jurisdiction in accordance with statutory consumer protections.
